REGULAR TOWN BOARD MEETING

SEPTEMBER 14, 2020

SUPERVISOR MERLINO CALLED THE MEETING TO ORDER WITH THE FOLLOWING PRESENT:  COUNCILMAN O’NEAL, COUNCILMAN LEWANDOWSKI, COUNCILMAN MCLAIN, COUNCILMAN WATERHOUSE.  ALSO PRESENT:  ZEO, KAREN PUTNEY AND LEGAL COUNCIL, ROBERT REGAN.

ABSENT: HIGHWAY SUPERINTENDENT, RON DEUEL.

FLOOR OPEN TO PUBLIC:

MICHAEL SCHAFER, ALONG WITH KURT TELKOSTE AND JANE OPPANDLANDER GAVE A BREIF PRESENTAITON OF TOOLS AND TESTING EQUIPMENT USED AND HOW THEY WORKED WHEN SAMPLING WATER FROM THE LAKE. ALL OF THE TESTING THAT HAS BEEN DONE HAS BEEN SENT TO THE LAB AND SHOULD RECEIVE A FULL REPORT LATE FALL OR EARLY SPRING.  INVITED BOARD MEMBERS TO GO ON BOAT TO OBSERVE THE PROCESS.

PUBLIC HEARING ON PROPOSED LOCAL LAW NO. 2 OF 2020 ALLOWING TRAVEL TRAILERS TO BE PERMITTED USE AS A DWELLING.  ATTORNEY REGAN EXPLAINED THE LAW AND ZONING TABLES, MINIMUM LOT SIZE, PRINCIPAL BUILDINGS ETC., DEPUTY TOWN CLERK READ PUBLIC HEARING NOTICE INTO THE RECORD.

RANDI JEAN BROWN – 873 EAST RIVER DRIVE

CONCERENED ABOUT HURTING THE VALUES OF THE SURROUNDING NEIGHBORHOOD.  THEY ARE TAXES AS VACANT LAND BUT NOW ARE NOT VACANT LAND ONCE THE TRAILER IS PLACE AND FEELS THAT IF RESIDENTS ARE NOT PAYING TAXES ETC.  THEY WILL NOT TAKE GOOD CARE OF THE PROPERTY.  THE OWNER OF THE TRAVEL TRAILER ACROSS THE STREET HAVE SEPTIC AND WATER WASTE GOING DOWN TOWARD THE STREET AND ARE BURNING GARBAGE AND SHOULD HAVE SOME KIND OF A PERMIT.

LEGAL COUNCIL REGAN STATED THAT IF THIS LAW WORKS THEY WAY IT IS INTENDED EVERYONE THAT WANTS TO PLACE A TRAVEL TRAILER ON VACANT LAND WILL HAVE TO GET A SPECIAL USE PERMIT.  IT WILL NOT BE EASY, NOT ONE SIZE FITS ALL BUT THE PLANNING BOARD CAN IMPOSE PERAMITERS AS TO SEPTIC PLACEMENT AND/OR REMOVAL, FENCING, LANDSCAPING ETC.

SUE DOUCET – CONCERNS ABOUT HOW LONG SPECIAL USE PERMIT IS GOOD FOR IF IT STAYS WITH THE PROPERTY AND GOES ON TO THE NEW OWNER, AGING TRAILERS CONCERENS, HOW THEY ARE TAXED AND HOW WOULD IT EFFECT PROPERTY VALUES OF OTHERS.

LEE SHIVER – IF MOSTINGLY USED FOR WEEKENDS, MOST MAY NOT BE ABLE TO HAVE SPETIC.

UNKNOWN – IF SPECIAL USE PERMIT IS PERMENANT, CAN IT BE REVOKED IF GUIDELINES ARE NOT FOLLOWED?

LEGAL COUNCIL REGAN – YES IF THEY DON’T FOLLOW WHAT IS SET FORTH IN THE PERMIT.

UNKNOWN – WILL THAT VERBIAGE BE IN THE LAW ABOUT REVOKING AND CONDITIONS?

LEGAL COUNCIL REGAN -YES IT CAN BE AND IT WILL BE SPECIFIC AND YES IT CAN BE REVOKED.

ED KEYROUZE – 42 SYLVAN ROAD

CONCERNED ABOUT SOMEONE BUYING VACANT LAND OR LAND WITH OLD STUCTURE AND THEY TAKE IT DOWN AND THERE ARE NICE HOUSES ALL ALONG IN THAT AREA, WILL IT CHANGE THE NEIGHBORHOOD HOW IT WILL AFFECT PROPERTY RESALE VALUES AND COULD AFFECT PEOPLE LIVING THERE .

LEGAL COUNCIL REGAN –THAT IS WHY WEVE HAD DISCUSSIONS ON THIS APPROACH SO MANY DIFFERENCT SENARIOS, THERE WILL BE FLEXIBILITY BY TOWN GOVERNMENT, PLANNING BOARD CAN ATTACHED REQUIREMENTS AND HOW IT IS PLACED AND WILL ALSO LOOK THE AFFECTS ON THE NEIGHBORHOOOD AND SURROUNDING PROPERTY AND LONG TERM AFFECT ON ENVIRONMENT.  LOOKED INTO CERTAIN SECTIONS OF TOWN TO ALLOW THEM OR NOT, THERE IS NO WAY TO GET A PERFECT LAW TO COVER ALL SENARIOS IT WOULD BE MORE A CASE BY CASE BASIS.

SURPRISED THAT THERE IS A ONE TIME FEE FOR A ONE TIME SPECIAL USE, NOT ANNUAL MAY BE SOMETHING TO CONSIDER.

LEGAL COUNCIL REGAN – THAT REALLY HASN’T BEEN DISCUSSED

SUE DOUCET – IN REGARDS TO TRAILERS PLACED AFTER JANUARY 1, 2020 WILL THEY HAVE TO APPLY FOR THE PERMIT, CAN THEY LEAVE TRAILER THERE OR WILL IT HAVE TO BE REMOVED WHILE GOING THROUGH THE PROCESS, SHOULD THERE BE A TIME PERIOD IN WHICH TO APPLY TO BE LEGAL.

WHY RETROACTIVE TO JANUARY 1, 2020

COUNCILMAN LEWANDOWSKI – IT’S BEEN BEING DISCUSSED SINCE JANUARY 1, 2020 IT’S BEEN A SLOW PROCESS

SUPERVISOR MERLINO – WE ARE GETTING A LOT OF CALLS FROM PEOPLE THAT WANT TO BUY PROPERTY AND WANT TO KNOW IF THEY CAN DO IT.

LEGAL COUNCIL REGAN – WE CAN’T GO BACK VERY FAR BECAUSE IT HAS BEEN GOING ON A LONG TIME, BUT WE WOULD LIKE TO GO BACK A LITTLE WHILE.  THE ALTERNATIVE IS AS OF JANUARY WE ARE ALLOWING IT, BEFORE THAT WAS TECHINICALLY WAS ILLEGAL.

JACK HERRING – ASKED FOR CLARIFICATION ON THE PURPOSE AREN’T THEY ALLOWED NOW.

COUNCILMAN REGAN- IT WASN’T ON THE TABLE OF USES AND IF IT ISN’T THERE IT IS CONSIDERED ILLEGAL.

LEGAL COUNCIL REGAN – IF YOU HAVE A PRINCIPAL BUILDING YOU CAN PARK AND STORE WITHIN SO MANY FEET FROM THE PROPERTY LINEBUT CANNOT LIVE IN IT.

JACK HERRING – REGARDING SEPTIC, DOES THIS MEAN APPLICANT GO THROUGH THE FULL APPROVAL FOR SEPTIC.

LEGAL COUNCIL REGAN – THAT WILL BE UP TO THE PLANNING BOARD BECAUSE THEY WILL LOOK AT EACH CASE SEPARATELY

JACK HERRING – ACCORDING TO HOW IT IS WORDED NOW THAT’S HOW IT IS, WHAT ABOUT WATER, IF THERE IS NO TOWN WATER, WILL A WELL HAVE TO BE DRILLED.

LEGAL COUNCIL REGAN – YOU ARE CORRECT ABOUT THE PROCESS, AS FAR AS WATER WHATEVER WOULD BE APPLICABE TO A SINGLE-FAMILY DWELLING WOULD APPLY TO THIS.

JACK HERRING – IN REGARD TO THE PLANNING BOARD, THE PLANNING BOARD APPROVED A MOBILE HOME ON DAVERN DRIVE IN AN HR DISTRICT.

ZEO PUTNEY – AS OF 2015 MOBILE HOMES ARE NOW ALLOWED IN ANY ZONE THAT A SINGLE-FAMILY HOME IS ALLOWED.

FRED ZUBAL – STEWART DRIVE

IS THE COUNTY GOING TO BE INVOLVED REGARDING CERTIFICATE OF OCCUPANCY?

ZEO PUTNEY – NOT THAT I AM AWARE OF, STATE BUILDING CODE DOES NOT GOVERN TRAVEL TRAILERS, I BELIEVE WHAT IS TRYING TO BE ACCOMPLISHED HERE IS TO HAVE SOME KIND OF OVERSIGHT AS TO WHERE AND HOW THEY ARE PLACED, HOW WASTE WILL BE HANDLED.  A LOT ARE SET UP TO BE PUMPED OR DRIVED INTO A DUMP STATION OR COULD MAKE THEM HOOK INTO A SEPTIC SYSTEM.  WATER, UNDER BUILDING CODES, THEY ARE NOT A HOME, BUT FOR A HOME YOU CAN BRING IN PORTABLE WATER TO A HOUSE YOU DO NOT HAVE TO BE HOOKED TO TOWN WATER OR PRIVATE WATER.  EACH SPECIAL USE PERMIT WILL BE REQUIRED TO HAVE A PUBLIC HEARING AND FOLLOW CERTAIN GUIDELINES, WHICH COULD BE ON A CASE BY CASE BASIS.

FRED ZUBAL – IF THE COUNTY ISN’T INVOLVED WILL THE TOWN GIVE THE CERTIFICATE OF OCCUPANCY

ZEO PUTNEY – NO, WHEN THEY ISSUE SPECIAL USED PERMITS FOR RESTAURANTS ETC, THE TOWN DOES NOT ISSUE CERTIFICATE OF OCCUPANCY.  WHEN ISSUED A SPECIAL USE PERMIT, AS ZONING OFFICER, I WOULD HAVE TO ISSUE A CERTIFICATE OF COMPLIANCE MEANING THEY SET IT UP IN ACCORDANCE WITH WHAT THE PLANNING BOARD REQUIRED OF THE APPLICANT.

PUBLIC HEARING CLOSED.

RAYL ZUBAL – EAST RIVER DRIVE

IF GOING BACK TO JANUARY 1, 2020, IT SOUNDS LIKE YOU ARE SETTING A LOT OF RESIDENTS UP FOR A LAWSUITE TO APPEASE A FEW PEOPLE.  IT SHOULD BE EFFECTIVE  JANUARY 1, 2021.

THERE WAS DISCUSSION ON HOW THESE SHOULD BE ASSESSED COMPARED TO A PARCEL WITH A DWELLING, SUPERVISOR SAID THAT IS AN ASSESSOR QUESTION.  BOARD TABLED VOTE AS IN GENERAL THEY ALL FEEL THAT MORE WORK NEEDS TO BE DONE.

COUNCILMAN WATERHOUSE – IF THERE IS A SAFETY ISSUE, THEN IT WOULD HAVE TO BE ADDRESSES EITHER WAY.

 

FLOOR OPEN TO THE PUBLIC:

GLENN SHIEL – OLD STAGE ROAD

IN THE FALL OF 2018 TOWN PURCHASED A PONTOON BOAT (MILFOIL HARVESTING BOAT) THE TOWN PUT THOUSANDS OF DOLLARS INTO IT AND NOBODY KNOWS WHERE THE BOAT WENT.  SUPERVISOR MERLINO SAID THE BOAT IS THERE.  MR. SHIEL SAID THAT ISN’T OUR BOAT.  SUPERVISOR MERLINO SAID WE TRADED OUR BOAT FOR A BETTER BOAT BECAUSE IT WASN’T BIG ENOUGH AND LEAKING OIL, MR. SHIEL SAID THE ORIGINAL BOAT SHOULD HAVE BEEN SURPLUSED AND WAS JUST SOLD.  SUPERVISOR MERLINO SAID THE BOAT WAS NOT SOLD, IT WAS TRADED FOR AN UPDRADED ONE THAT WAS IN BETTER SHAPE IN ORDER TO DO A BETTER JOB AND IT IS SAVING THE TOWN $30,000 A YEAR.  MR. SHIEL ACCUSED SUPERVISOR MERLINO OF BEING A LIAR AND CHEATER AND THAT HE WILL PROVE THIS OVER THE NEXT YEAR.  MR. SHIEL SAID HE WANTED TO SEE THE REGISTRATION, SUPERVISOR MERLINO SAID IT THERE IS NO REGISTRATION REQUIRED ON A WORKING WATER VESSEL. MR. SHIEL THEN ASKED TO SEE A BILL OF SALE OR SOMETHING THAT PROVED THE BOAT BELONGS TO THE TOWN.

MRS. KEYROUZE – SYLVAN

CONCERNED ABOUT BOAT AND KYAK STORGE BY THE BEACH – FEELS IT NEEDS A LOT OF ATTENTION IN REGARD TO TRAFFIC AND MAINTENANCE OF SITE.  A LOT OF BOATS HAVE NOT BEEN USED SINCE BEING PLACED THERE IN THE SPRING.  WANTS THEM MOVED TO THE PUBLIC BEACH.

COUNCILMAN O’NEAL SUGGESTED PUTTING NO PARKING SIGNS AND DEAD END ROAD SIGNS.

COUNCILMAN WATERHOUSE – MAYBE WE SHOULD NOT BE STORING THE BOATS.

LEGAL COUNCIL REGAN – ACCORDING TO THE GUY GROM THE STATE THERE IS $72,000 SITTING IN GLENS FALLS NATIONAL BANK, JUST REVIEWING ALL THE RECORDS BEFORE THE FINAL STEP IS TAKEN.  SUPERVISOR WANTS TO BE SURE OF THE STATUS.

SUPERVISOR MERLINO – GAVE REPORT FOR HIGHWAY SUPERINTENDENT AS FOLLOWS:

CHANGED A COUPLE OF WATER VALVES ON THE HEIGHTS AND FINISHED PAVING 1 MILE OF BLACKTOP ON GAGE HILL RD, ½ MILE ON GAILEY HILL RD AND OPE TO DO ½ MILE BY PAINTED PONY.  THE CULVERT REPLACEMENT IN COMPLETE BY PAINTED PONY.

**Discussion of proposed new ordinance regarding placement of “free” items on a parcel and length of time allowed.  Town Attorney will introduce the proposed change.

**Discussion of regulations regarding recreational vehicles on properties—called for a workshop meeting on July 30th.  Town Attorney will discuss the Planning Board recommendation. 

Violations and/or Complaints:  One written complaint received, forwarded to the Town Attorney—after looking into it, the complaint was determined unfounded.

Due to a resignation on the Planning Board we now need 2 alternates—one for the Zoning Board of Appeals and one for the Planning Board.

DEPUTY TOWN CLERK – PROVIDED BOARD MEMBERS WITH AUGUST MONTHLY REPORT

SUPERVISOR MERLINO – REMINDED EVERYONE TO FILL OUT CENSUS INFORMATION AND SUBMIT.

SPOKE WITH THE FORESTER, MR. GEARWAR AND HE FEELS THAT PROCEEDS FROM HARVESTING MAY BE MORE THAN ANTICIPATED.

FELT THAT THE EXPLANATION OF THE BOAT WAS NOT ACCEPTABLE, HAVE BEEN TRYING TO  GET DOCUMENTS ON THE BOAT FOR A FEW MONTHS THE ONLY THING I GOT WAS VOUCHER FOR PAYMENT AND COPY OF CHECK.  THE SUPERVISOR DOES NOT HAVE THE AUTHORITY TO TRADE TOWN PROPERTY.  THERE ARE SEVERAL THOUSAND DOLLARS AT STAKE.  I WANT TO KNOW WHERE THAT MONEY IS, IF WE OWN THAT BOAT AND WHERE ALL THE MONEY IS, I DID NOT GET ANY  DOCUMENTS REFERENCING THE TRADE, OWNERSHIP, REGISTRATION OR WHAT THEY PAID FOR IT.  ASKED COUNCILMAN WATERHOUSE TO ASK WHERE ALL THAT MONEY IS BECAUSE IT ISN’T GOING TO END HERE.  SOMETHING STINKS, THE MONEY IS MISSING AND THE PROPERTY IS MISSING

ROBERTA VANDERZEE – CONCERNED ABOUT THE DEVELOPMENT OF 105 ACRES OWNED BY THOMAS REED ON AND RESIDENTS WILL FIGHT AGAINST APA CHANGING ZONING.  FOUND ONLINE THAT MR. REED HAS A REGISTERED REAL ESTATE BUSINESS.

MARY ELLEN ALLISON – ASKED WHY THE TOWN APPLIED TO THE APA FOR A ZONING CHANGE.  ATTORNEY REGAN EXPLAINED THAT THE TOWN ITSELF DID NOT APPLY AND HOW THE PROCESS WORKS.

MIKE FAZIO – FEELS THAT THE BOOKS FOR THE CEMETARY SHOULD BE FULLY AUDITED PRIOR TO THE TOWN TAKING IT OVER.

GLENN SHIEL- QUESTION DIRECTED TO COUNCILMAN MCLAIN, LAST YEAR YOU HIRED SOMEONE TO MOW THE CEMETARY, IS THAT CORRECT?  COUCILMAN MCLAIN SAID NO AND THAT HE WAS HIRED BY THE TOWN.  MR. SHIEL ASKED HOW CAN YOU TAKE AN EMPLOYEE FROM THE LAMPLIGHT INN AND PUT AS A TOWN EMPLOYEE TO HAVE INSURANCE TO WORK IN THE CEMETARY, THAT IS INSURANCE FRAUD, SUPERVISOR MERLINO STATED THAT THE CEMETARY PAID HIM,  HE WASN’T A TOWN EMPLOYEE, MR. SHIEL SAID THERE PROBABLY ISN’T ANY RECORD OF HIM BEING A TOWN EMPLOYEE.  MR. SHIEL WANTED TO KNOW WHO INSURED HIM.  THERE IS NOTHING WORSE THAT BEING LIED TO YOUR FACE, COUNCILMAN MCLAIN STATED THAT HE GOT A REPORT AND WROTE A CHECK TO THE TOWN TO FOR REIMBURSEMENT.  MR. SHIEL SAID  IT’S A MESS ALL THIS CORRUPTION IS JUST BEGINNING TO UNFOLD, NEXT MONTH I WILL COME IN AND SHOW THE GAGE ORDER THAT THE TOWN PUT ON ME TO KEEP MY MOUTH SHUT AND HOLD MONEY OWED TO ME UNTIL IT WAS SIGNED.  MR. MERLINO SIGNED IT AND YOUR ATTORNEY MADE IT UP.
