Town Board Meeting Minutes for 10/13/2021

TOWN OF LAKE LUZERNE 

REGULAR TOWN BOARD MEETING 

OCTOBER 13, 2021 

 

 

Supervisor Merlino called meeting to order at 7 pm with the following members present: Councilman O’ Neal, Councilman Lewandowski, Councilman Fazio, Councilman Waterhouse. Also present: Highway Supt. Ron Deuel, Deputy Highway Supt. Logan Brooks, Zoning Officer, Karen Putney and Attorney for the Town Michael Crowe. 

 

 

Discussion regarding the request for water service in the NYS Fourth Lake Campground on Route 9n. There is a report packet regarding water hook up and good water pressure. A new hydrant cost will be at the expense ofthe State. It is proposed that a line will be put under route 9n . 

 

 

Motion by Councilman Waterhouse seconded by Councilman O’ Neal to accept the minutes of the September 7th agenda meeting, the September 21″ regular town board meeting and the October 0 agenda meeting. All in favor, aye, none opposed. Carried 5- 0.

 

 

Resolution 152 of 2021—Introduced by Councilman Waterhouse, Seconded by Councilman O’ Neal 

Resolution Authorizing Payment of Monthly Vouchers ofthe 10th Abstract as Filed in the Office of the Town Clerk of Lake Luzerne 

WHEREAS, the Town Board of lake Luzerne is obliged to review various vouchers submitted for payment and shall review same on a monthly and/ or periodic basis for confirmation and accuracy, and authorize payment of same, pursuant to and in compliance with the Laws ofthe State of New York, Warren County and the Town of Lake Luzerne; and 

The totals for the numbered vouchers in the lOth abstract are as follows: 

General Fund 27809-27852 26,253. 88 

Highway Fund 27786-27808 12,770.07 

SWI Water 27853- 27864 33, 848. 19 

SW2 Water 27865 25. 00 

NOW, THEREFORE, BE IT RESOLVED, that the Supervisor is hereby authorized to pay the monthly vouchers approved and set forth above from the 10th Abstract of2021. All in favor, aye, none opposed, carried 5- 0. 

 

 

Resolution 153 of2021— Introduced by Councilman Fazio, Seconded by Supervisor Merlino 

Resolution Authorizing the Allocation of and Payment from the Town of Lake Luzerne Occupancy Tax Funds” to Support the Pug Parade

WHEREAS, the Town of Lake Luzerne annually received its share of Occupancy Tax revenue from Warren County to be used to support and promote travel and tourism in the Town; and 

WHEREAS, the Town Board has identified the Pug Parade as an appropriate and eligible event to receive a portion of said Occupancy Tax funds. 

NOW, THEREFORE, BE IT RESOLVED, that the Supervisor is hereby authorized to distribute funds in the total amount of$831. 50 for the following items relating to the Pug Parade: Absolute Sounds- $ 200.00; Tables and Chairs Rentals- $ 245.00; Printing of Certificates and Posters 140.50; Advertising in local newspapers- $ 246.00.

Resolution 154 of2021— Introduced by Councilman O’ Neal, Seconded by Councilman Waterhouse 

Resolution Authorizing the Payment in the Amount of$1, 342.53 to Joan Miraglia for Vehicular Damages Sustained on Glens Falls Mountain Road During Town Highway Department Roadwork 

WHEREAS, on or about August 2, 2021, Joan Miraglia sustained damage to her vehicle while driving on Glens Falls Mountain Road through a marked Town Highway Department roadwork project; and 

WHEREAS, the estimate ofthe amount ofdamages sustained to the vehicle is $ 1, 342.53; and 

NOW, THEREFORE, BE IT RESOLVED, that the Supervisor is hereby authorized to make payment in the total amount of$1, 342.53 to Joan Miraglia for vehicle damage sustained while traveling on Glens Falls Mountain Road through a marked Town Highway Department roadwork project. 

All in favor, Aye, None Opposed, Carried 5- 0. 

 

 

Resolution 155 of2021 —Introduced by Councilman Waterhouse, Seconded by Councilman Lewandowski 

Resolution Authorizing Councilman Fazio to Seek Quotes for the Purchase of an IPad to be used by the Zoning Officer and Assessor while in the Field 

WHEREAS, it has been determined that it is in the best interests ofthe Town to procure an Ipad for use by the Zoning Officer and the Assessor while in the field for efficiency and for proper recording keeping; and

WHEREAS, it was determined that Councilman Fazio has the most expertise in this area and will seek cost proposals to be presented to the Town Board for consideration. 

NOW, THEREFORE, BE IT RESOLVED that Councilman Fazio is hereby authorized and directed to seek cost proposals for an IPad to be presented to the Town Board for consideration to be used by the Zoning Officer and Assessor.

Resolution 156 of2021 —Introduced by Councilman Waterhouse, Seconded by Councilman Fazio 

Resolution setting dates for: 1. Town Board Budget Workshop Special Meetings; 2. Public Hearing on Preliminary Budget; 3. Special Town Board Meeting to adopt Final Budget 

NOW THEREFORE BE IT RESOLVED, THE DATES AND TIMES ARE SET AND ESTABLISHED AS FOLLOWS: 

Town of Lake Luzerne Town Board 

2022 Budget workshop Special Meetings: 

Wednesday October 20, 2021 6 pm 

Wednesday October 27, 2021 6 pm 

Public Hearing on Preliminary Budget- Wednesday November 3, 2021 @ 6: pm Agenda Meeting ofthe Town Board – Wednesday November 3, 2021 @ 7 pm November Regular Meeting ofthe Town Board: Monday November 8, 2021 @ 7pm Special Town Board Meeting to Pass Budge: Monday November 15, 2021 @ 7 pm 

Further be it Resolved, to ensure complete Transparency in Town Government, the Tentative Budget shall be published immediately on the Town of Lake Luzerne website and made available to the public by the Town Clerk, and 

Further be it Resolved from this date forward, the annual Tentative Budget shall be made available to the Public on the date of Filing by the Budget Officer with the Town Clerk. All in favor, Aye, None Opposed, Carried 5- 0.

RAYL ZUBAL—COMMENTED ON THE TOWN BOARD MEETINGS STILL HELD BY ZOOM ONLY IN LIGHT OF OPEN SCHOOL BOARD MEETINGS. TOWN OF LAKE

 

PAM FAZIO- COMMENTS AND EXPRESSED HER DISDAIN FOR SUPERVISOR MERLINO FOR ALLOWING A CAMPAIGN ATTACK ON HER DAUGHTER NOTED IN A FLIER/POSTERS FROM A WRITE IN CANDIDATE. 

 

JAIMIEE KRANZ- UPSET THAT SHE WAS ACCUSED OF SHUTTING DOWN A ZOOM MEETING THAT NEVER HAPPENED AND QUESTIONED WHETHER SUPERVISOR AND OTHER CANDIDATES ENDORSED THE FLIER. 

 

PAM PETTEYS- ADVISED THAT THE POSTER WAS DONE BY ONE CANDIDATE AND THAT THE POSTER HAS BEEN CHANGED. 

 

SUPERVISOR SAID HE DOES NOT ENDORSE THE FLIER. 

 

COUNCILMAN FAZIO- EXPRESSED HIS FRUSTRATION AT THE CAMPAIGN TACTICS BY THE WRITE IN CANDIDATES AND THE INVOLVEMENT OF HIS DAUGHTER AND HER WORK IN CAMPAIGN MATERIAL. 

 

JAIMEE KRANZ- EXPRESSED HER LOVE OF HER TOWN AND HOW HURT AND APPALLED SHE IS BY THE CAMPAIGN MATERIAL. 

 

COUNCILMAN WATERHOUSE- APOLOGIZED ON BEHALF OF THE BOARD AND THAT HER GREAT GRANDMOTHER ( FORMER TOWN CLERK) WOULD BE PROUD OF HER. 

 

COUNCILMAN FAZIO- READ A STATEMENT REGARDING THE TREATMENT OF HIS DAUGHTER DURING THE CAMPAIGN BY THE WRITE IN CAMPAIGN. COMPLIMENTED HER ON HER WORK ETHIC AND WEBSITE UPGRADES AND THE MONEY SAVED($ 60 PR HR) FROM THE PRIOR PROVIDER AND DOING A BETTER JOB. NOTED THAT SHE COULD HAVE GONE ANYWHERE WITH HER COLLEGE EDUCATION AND CHOSE TO SETTLE IN LAKE LUZERNE, AS HAVE OTHER LOCAL GRADUATES OF HL. 

 

 

MOTION BY COUNCILMAN FAZIO, SECONDED BY COUNCILMAN WATERHOUSE TO ADJOURN TO EXECUTIVE SESSION TO DISCUSS A PERSONNEL MATTER WITH NO FURTHER BUSINESS TO BE DISCUSSED UPON RETURN FROM THE EXECUTIVE SESSION EXCEPT TO ADJOURN THE MEETING. ALL IN FAVOR, AYE, NONE OPPOSED, CARRIED 5- 0.
