REGULAR TOWN BOARD MEETING

AND PUBLIC HEARING

TOWN OF LAKE LUZERNE

SUPERVISOR CALLED MEETING TO ORDER AT 7 PM WITH THE FOLLOWING MEMBERS PRESENT: COUNCILMAN O’NEAL, COUNCILMAN LEWANDOWSKI, COUNCILMAN WATERHOUSE. ALSO PRESENT: HIGHWAY SUPT DEUEL, ZEO PUTNEY, ATTORNEY FOR THE TOWN, ROBERT REGAN.

SUPERVISOR ADVISED THAT PUBLIC HEARING IS CANCELLED.

TRACEY CLOTHIER, GRANT WRITER AND JOHN SUKA FROM THE TOWN’S ENGINEERING COMPANY REGARDING POSSIBLE FUNDING FOR WATER INFRASTRUCTURE GRANTS.  TRACEY COULD NOT BE HERE TONIGHT,

JOHN SUKA- CEDARWOOD ENGINEERS – WILL MEET WITH TRACEY AND COME BACK NEXT MONTH.  IN 2017 THE TOWN WENT AFTER GRANT MONEY FROM ENVIRONMENTAL FACILITIES CORP.  THE APPLICATION IS UPDATED EVERY YEAR.  DUE TO COVID, AND THE STATE OF THE ECONOMY, NOTHING HAS BEEN ANNOUNCED RIGHT NOW.

COUNCILMAN WATERHOUSE DISCUSSED THAT HE READ AUGUST 1ST CONGRESS SAID 1 TRILLION DOLLARS FOR INFRASTRUCTURE UPDATE WILL BE MADE AVAILABLE.  HE WOULD LIKE TO HAVE THE APPLICATION OUT THERE ASAP TO NOT MISS IT AGAIN.

  1. SUKA- THE PROBLEM IS THAT THE PROJECT IS STRAIGHT INFRASTRUCTURE REPLACEMENT THAT HAS NOT BEEN SCORING HIGH ENOUGH FOR FUNDING. THE HIGHER SCORING PROJECTS RIGHT NOW ARE TO DO WITH WATER QUALITY ISSUES. PFOA CONTAMINATION AND THE LIKE.  THE ORIGINAL PAPERWORK ALREADY AND CONTAINS THE ENVIRONMENTALS ARE ALL COMPLETED AS FAR AS THE PROJECT GOES FOR THE SPECIFIC AREAS. ALL THE SEQR IS DONE, THE BOND COUNSEL, WE ALREADY HAVE A RESOLUTION FOR THE PROJECT. THE APPLICATION IS DONE AS WELL, SO ALL WE HAVE TO DO FOR THE NEXT ROUND WHEN ANNOUNCED IS UPDATE THE BUDGET. WE WILL MEET WITH THE TOWN AND COME UP WITH DOCUMENTED ITEMS SUCH AS PICTURES, AND/OR DISCOVERY OF BAD PIPING, LOW PRESSURE AT HOUSES, LETTERS OF SUPPORT POLITICALLY FOR THE PROJECT.  ANY OF THAT WILL STRENGTHEN  THE CAUSE.   UNFORTUNATELY WITH STRAIGHT INFRASTRUCTURE YOU DON’T HAVE ANY VIOLATIONS WITH DOH  OR EPA THAT HELP THE PROJECT SCORE BETTER.

 

  1. WATERHOUSE – IN READING, THERE ARE TAX CREDITS FOR TOURISM WHICH COULD BE INCORPORATED.
  1. SUKA – EXPANSION HAS TO BE APPROVED AND A READY TO GO PROJECT. PICTURES OF PIPING ETC, DOCUMENTED COMPLAINTS- DO HELP.

THE 2017 GRANT WAS 2.5 MILLION AND THE AREAS WERE THE HEIGHTS AND LAKE TOUR ROAD, PINE, CHURCH ST, LAWRENCE ST.,  HILL ST AND THE WATER TANK REFURBISHMENT.  SUPERVISOR SAID THAT WE LOST IT BASED ON THE HEIGHTS BECAUSE THERE ARE NOT ENOUGH FULL TIME RESIDENTS.

WATER SUPT DEUEL SAID BAY ROAD IS PROBABLY THE OLDEST PIPES AND BRIDGE STREET.  ANY LEAD JOINTS WOULD ADD TO THE APPLICATION.

  1. SUKA – IF YOU ADD EVEN 100 FT TO THE APPLICATION IT IS A TYPE 1 ACTION THAT WILL TAKE 30 DAYS REVIEW, A LITTLE TIME BUT SOMETHING YOU WOULD WANT TO DO TO PUSH FORWARD. HE WILL MEET WITH SUPT DEUEL TO REVIEW THE AREAS AND ISSUES TO POSSIBLY UPDATE ENVIRONMENTALS.

OTHER AVENUES FOR GRANT FUNDING WERE ALSO DISCUSSED.

PAVING A SMALL PORTION OF ROAD ON GAILEY HILL BECAUSE OF COMPLAINTS OF PEOPLE HAVING TO GO INTO THE OTHER LANE ON BLIND CORNERS AND NEAR ACCIDENTS.

GAGE HILL WILL BE NEXT WEEK, WEATHER PERMITTING

SECOND BRUSH PICK UP ON THE 27-30 OF JULY

MULTIPLE COMPLAINTS OF BRUSH ON THE ROADS. THERE IS A TIME SCHEDULE FOR PAVING. WHEN THE CREWS CAN COME. THEREFORE HE IS PREPPING THE ROAD FOR THAT AND WILL GET TO THE BRUSH WHEN HE CAN.

SUPERVISOR ASKED ABOUT POT HOLES ON PIERREPONT.  HE WILL GET UP THERE WITH COLD PATCH.

MOWER WAS OUT FOR A WEEK FOR REPAIRS.

THE LOADER NEEDS TIRES. IT IS A SAFETY ISSUE. AND THEY ARE EXPENSIVE.

REPORTED THE AG AND MARKETS  DOG CONTROL INSPECTION REPORT WAS SATISFACTORY

TOWN CLERK ASSOCIATION CONFERENCE THAT SHOULD HAVE BEEN IN APRIL 2020 WAS POSTPONED TO AUGUST DUE TO COVID 19 AND IS NOW POSTPONED AGAIN UNTIL APRIL 2021.

NOTICE OF PUBLIC HEARING IN QUEENSBURY ON JULY 20 ON LOCAL LAW TO REESTABLISH A TEMPORARY MORATORIUM ON INSTALLATION OF GROUND MOUNTED SOLAR ENERGY SYSTEMS.

ATTORNEY FOR THE TOWN – ROBERT REGAN

SARATOGA COUNTY ATTORNEY DISCUSSION REGARDING THE RENEWAL OF THE CELL TOWER AGREEMENT.  QUESTIONS OF TAX RECORDS ETC. ALSO LOOKING AT DEED REFERENCED DECISIONS BY JUDGE KROGMANN THAT IS BEING WORKED ON.  PART OF IT NEEDS TO BE RENEWED ANYWAY. MORE ON THAT TO COME.

THE APA NOTIFIED THE TOWN THAT THEY ARE STILL UP IN THE AIR ABOUT  THE REED PROPERTY IN LAKE VANARE.  THEY RECEIVED A LOT OF COMMENTS AGAINST THE PROJECT.  THEY WILL PUT IT OFF FOR ANOTHER MONTH FOR FURTHER DISCUSSION.

THE TOWN BOARD COULD MAKE THE DECISION OR LET THE APA.  THE DISCUSSION IS LEANING AGAINST BECAUSE THEY HAVE SO MUCH OPPOSITION.

SUPERVISOR SOMETIMES QUESTIONS THE RALLY AGAINST SOMETHING THAT COULD HELP THE TOWN.

  1. WATERHOUSE, – WE SAW THAT WITH MONT LUZERNE PROJECT.

ZEO –  16 COMMENTS WERE AGAINST THE REED PROJECT AND 4-6 WERE FOR IT.

PROJECT PLANS ARE NOT BROUGHT FORTH UNTIL HE GET APPROVAL THAT HE CAN DO SOMETHING.  IF APA SAYS IT CAN BE DONE, THEN HE WOULD BRING PLANS TO THE PLANNING BOARD.

ZEO – IN ORDER FOR HIM TO PLAN WHAT HE WANTS OR TO ADJUST WHAT HE WANTS, HE NEEDS TO KNOW WHAT THE FINAL APA CLASSIFICATION OF THE PROPERTY IS SO HE KNOWS HOW MANY BUILDINGS HE CAN HAVE PR HOWEVER MANY ACRES.

ZEO – APA IS NOT LOOKING AT THE PROJECT, JUST THE LAND RECLASSIFICATION BASED ON TOPOGRAPHY OF LAND, SOIL MAKE UP, HOW SITUATED TO OTHER ROADS.   WHAT THE TOWN APPLIED FOR IS THAT SOME OF THE LAND IS OUTSIDE OF THE LAND THAT THE GENTLEMAN OWNS. IT IS JUST A LAND RECLASSIFICATION THAT WOULD ALLOW FOR MORE DEVELOPMENT IN THAT AREA THAN IS CURRENTLY ALLOWED.

IT WOULD BE UP TO THE BOARD AS TO WHETHER THEY WANT TO CONTINUE TO PURSUE THE CHANGE OR MODIFY THE APPLICATION OR WITHDRAW IT.

ATTORNEY REGAN – MR REED SAID THAT THE TOWN WOULD HAVE TO REQUEST A CONTINUANCE IF THE MATTER IS TO BE KEPT ALIVE.

ZEO – THAT WAS DONE MOVING IT TO SEPT OR OCT.  MR. REED CALLED AND SHE DIRECTED HIS CALL TO THE ATTORNEY.  AN EXTENSION OF TIME WAS REQUESTED AND GRANTED FROM JULY TO OCTOBER.

ATTORNEY ADVISED HE RECEIVED A LETTER FROM ATTORNEY BITTER REPRESENTING PEOPLE ON EAST RIVER DRIVE REQUESTING THE TOWN ENFORCE RULES AS THEY SEE THEM AS IT PERTAINS TO TRAVEL TRAILERS.  THE TOWN DISCUSSION HAS BEEN WHERE TO GO WITH THIS IN THE FUTURE AND WHERE AND HOW AND UNDER WHAT CIRCUMSTANCES THEY SHOULD BE ALLOWED.   ATTORNEY PROPOSAL IS TO PUT TOGETHER AN AMENDMENT TO THE ZONING LAW AND PRESENT TO THE BOARD AT THE AUGUST MEETING AND DISCUSS HOW TO APPROACH THE ENTIRE QUESTION OF TRAVEL TRAILERS AND MAKE A DECISION AS TO WHAT IF ANY ACTION TO TAKE.

COUNCILMAN LEWANDOWSKI – ASKED FOR STATUS OF CEMETERY.

SUPERVISOR ADVISED THAT THE FUNDS ARE IN TOWN ACCOUNT AND WILL MEET WITH MIKE MILLER.  MAINTENANCE IS BEING DONE BY BUILDINGS AND GROUNDS.

MAIN BEACH ON BROADWAY- STAND UP BOARD WAS LAUNCHED FROM THE BEACH AREA AND THE LIFEGUARD WOULD NOT LET THEM RETURN THERE. ALSO BEING ASKED ABOUT STATE LAW SAYING YOU CAN ENTER WATER ANYWHERE IN NY STATE.  OVER BY THE BRIDGE FISHERMEN WANT TO FISH BY THE BRIDGE WHILE THEIR FAMILY SWIMS. WERE TOLD THEY CAN’T IF NOT IN THE ROPED OFF SWIMMING AREA. OVER BY THE BRIDGE AREA. SWIMMING ON THE TOWN PORTION OF SYLVAN IS NOT ALLOWED.  THERE IS NO LIFEGUARD. MR. LEWANDOWSKI IS BEING QUESTIONED ABOUT THESE RULES.  LIFEGUARDS ARE NOT ALLOWING FISHING TO THE RIGHT OF THE SWIMMING AREA.

THERE IS NO GARBAGE CAN AT THE END OF SYLVAN WHERE ALL THE KAYAKS ARE STORED.

  1. WATERHOUSE – DISCUSSION REGARDING THE DIFFICULTIES AT THE SMALL WAYSIDE BEACH IN CONTROLLING A 50% OCCUPATION PR COVID RESTRICTIONS, MOST OF WHICH ARE NOT FROM LAKE LUZERNE.

MR WATERHOUSE – TALKED ABOUT ARTICLE IN ADIRONDACK LIFE REGARDING FALLING STAR WHO IS BURIED IN THE LAKE LUZERNE CEMETERY BUT WITH NO MARKER.  A STONE WAS GARNERED FOR THAT GRAVE BUT IT WAS TOO BIG.  THE BOARD WILL REVISIT THAT PROJECT.

SUPERVISOR REPORT

DISCUSSED SUMMER AND WINTER SHIRTS FOR HIGHWAY DEPT.  HWY SUPT WILL REVIEW THE CONTRACT AS TO RETURN POLICY AND THE COST.

COMPLAINTS REGARDING RESIDENT THAT CUT TREES THAT ARE FALLING IN THE LAKE. SUPERVISOR WILL GO ON THE LAKE AND SEE WHERE IT IS.

THE OLD GARBAGE TRUCK COULD BE USED AS A BRINE TRUCK  WITH SOME MODIFICATIONS.  HIGHWAY SUPT AND SUPERVISOR TO LOOK INTO THE POSSIBILITIES.

MANY PROBLEMS ON THE BEACH WITH PEOPLE COMING FROM ALL OVER THE CAPITAL DISTRICT. SOMEHOW IT IS ON THE INTERNET THAT THE LAKE LUZERNE IS OPEN WITH NO RESTRICTIONS.  THIS HAS CREATED SOME OF THE PROBLEMS.

KAYAKS AND CANOES ARE ALLOWED ON THE LAKE. SUPERVISOR WOULD LIKE TO STOP CARS FROM GOING DOWN THE LAUNCH FOR THOSE TYPES OF WATERCRAFT THAT CAN BE HAND CARRIED.  SO MANY CARS BACKING DOWN THE LAUNCH WITH THE KIDS RUNNING BACK AND FORTH FROM THE BEACH SIDE TO THE GRASS SIDE.  HE WOULD LIKE TO LIMIT THE ACCESS TO  MOTOR CRAFT. BOARD TO THINK ABOUT THAT.

SUPERVISOR WOULD LIKE TO HAVE A PUBLIC HEARING AND LOCAL LAW REGARDING LIMITING NUMBER OF GARBAGE CANS TO BE PICKED UP BY THE TOWN AT EACH TAX PARCEL AND BUSINESS TO 6 CANS. THE BUSINESSES AND MOBILE HOME PARKS. DISCUSSION REGARDING DIFFERENCE BETWEEN LOCAL LAW AND A POLICY RESOLUTION AND WEBSITE ANNOUNCEMENT.  CLERK ADVISED THAT LANGUAGE FOR LOCAL LAW WOULD NEED TO BE AVAILABLE IN ADVANCE OF A MEETING. SUPERVISOR OUTLINED THOSE WHO ARE USING DUMPSTERS AND THOSE WHO ARE PUTTING OUT AN EXTRAORDINARY NUMBER OF CANS. SOME BUSINESSES DO NOT HAVE A LOCATION THAT WORKS FOR DUMPSTER.  THE GARBAGE TRUCK IS PICKING UP ENORMOUS AMOUNTS AT SINGLE LOCATIONS. ATTORNEY ADVISED THAT IF THEY WANT A LOCAL LAW THE BOARD HAS TO PASS ONE AS TO FORM THEN SET A PUBLIC HEARING DATE. THE OUTLINE OF IT IS A MAXIMUM 6 CANS PR BUSINESS OR GET A DUMPSTER.   CLERK ADVISED THERE IS NO SECTION OF LAW. THE ONLY REFERENCE TO DUMPSTERS IS IN THE ZONING ORDINANCE PERTAINING TO RESTAURANTS AND TAVERNS. SO TO PASS SOMETHING IT SHOULD BE REMOVED FROM THE ZONING ORDINANCE OR MAKE IT UNIFORM FOR ALL BUSINESSES. THE PLACEMENT IS WHAT IS ADDRESSED IN THE ORDINANCE.  NOT WHAT YOU ARE TALKING ABOUT AS TO NUMBERS.  ATTORNEY. AN AMENDMENT TO CURRENT ZONING LAW WILL HAVE TO BE VERY DETAILED TO TALK ABOUT THE SECTIONS ETC.

SUPERVISOR – THEY DON’T HAVE TO GET A DUMPSTER. THEY CAN TAKE THE GARBAGE TO THE TRANSFER STATION THEMSELVES OVER AND ABOVE THE 6 CANS.

ATTORNEY – SO THE ZONING LAW WOULD HAVE TO BE AMENDED TO ELIMINATE IT.  THAT IS MORE INVOLVED THAN A SIMPLE RESOLUTION THAT SAYS 6 CANS OR GET YOUR OWN DUMPSTER.  A STRICT PROCESS HAS TO BE FOLLOWED WITH THE BOARD PASSING THE EXACT LANGUAGE THAT THEN HAS TO BE IN A PUBLISHED LEGAL NOTICE .

 

  1. LEWANDOWSKI – LEAVE OUT DUMPSTER. THE BUSINESS OWNER HAS TO TAKE CARE OF THE EXTRA GARBAGE .
  1. O’NEAL – WHY CANT IT JUST BE A RESOLUTION REQUIRING THAT A BUSINESS WOULD GET AND MAINTAIN THEIR OWN DUMPSTER SERVICE AND HAVE IT SCREENED IN.

ATTORNEY – WHY NOT SAY THAT AT THE NEXT MEETING TIME WILL BE SET ASIDE TO DISCUSS THE ISSUE AND RECEIVE INPUT IN ORDER TO WRITE UP THE ORDINANCE.

THE BOARD DISCUSSION ENDED WITH CONSENSUS THAT 0VER 6 PAILS OF GARBAGE WILL BE TAKEN CARE OF BY THE TAXPAYER WHETHER IT IS TAKEN TO THE TRANSFER STATION OR BY DUMPSTER.  THAT CAN BE DONE BY RESOLUTION.

RESOLUTION  59  OF 2020 – RESOLVED UPON A MOTION BY COUNCILMAN WATERHOUSE, SECONDED BY COUNCILMAN LEWANDOWSKI THAT  BEGINNING SEPTEMBER 1ST  GARBAGE CAN PICK UP FOR RESIDENTS AND BUSINESSES  WILL BE  LIMITED  TO A MAXIMUM OF SIX (6), 35 GALLON CANS, WITH COVERS, PER TAX PARCEL.  ROLL CALL VOTE: COUNCILMAN O’NEAL, AYE, COUNCILMAN LEWANDOWSKI, AYE, COUNCILMAN WATERHOUSE, AYE, SUPERVISOR MERLINO, AYE.

SUPERVISOR ALSO DISCUSSED THE GROWING ISSUES OF AIR B&B.  NEIGHBOR COMPLAINTS OF LARGE PARTIES, NO SOCIAL DISTANCING OR MASK COVER. NOISE ORDINANCE VIOLATIONS.    SOME TOWNS ARE REQUIRING THAT THE AIR B&B  REGISTER WITH THE TOWN WITH A $50 PERMIT SO THAT WHEN THERE ARE PROBLEMS THE OWNERS CAN BE FOUND.

MORE DISCUSSION REGARDING LIMITING THE SMALL BEACHES TO LOCAL USE.  IT IS HARD TO HAVE YOUNG LIFEGUARDS PATROL, IDENTIFY, AND ENFORCE WHILE THEY ARE WATCHING THE WATER.  DISCUSSION AS TO HAVING CONSTABLE PATROL THE BEACHES FOR COMPLIANCE WITH COVID PLAN RESTRICTIONS.

DIFFICULTY WITH ZOOM HOOK UP.

LENGTHY DISCUSSION ENSUED REGARDING THE TRAVEL TRAILER SET UP ON VACANT LOT ON EAST RIVER DRIVE.

DISCUSSION ENTAILED PROCESS FOR AMENDING CURRENT ZONING LAW TO ADDRESS TRAVEL TRAILERS GOING FORWARD.  WHETHER TO ENACT NEW LAW OR AMEND CURRENT LANGUAGE.   ATTORNEY WOULD HAVE TO DRAW UP LANGUAGE FOR BE APPROVED AS TO FORM AND THEN THE TOWN BOARD WOULD SET A PUBLIC HEARING ON THAT LANGUAGE.   TOWN BOARD COULD VOTE AFTER THE PUBLIC HEARING IF AMENDMENTS WERE NOT VERY DIFFERENT THAN WHAT IS PROPOSED.

SEPTIC ISSUES WERE DISCUSSED FOR PLACING RV ON VACANT LOT. IF THE TOWN BOARD MAKES REQUIREMENTS THERE ARE MORE ENFORCEMENT ISSUES.  DISCUSSED WHAT RULES FOR WASTE DISPOSAL.  ELECTRICITY AS SOME RV ARE POWERED WITH SOLAR OR HOOK UP WITH POWER COMPANY..ASKED IF THE NEIGHBORS WOULD HAVE A SAY THE ANSWER IS YES AT A PUBLIC HEARING.  SITE PLAN REVIEW PROCESS WAS ALSO DISCUSSED FOR PLACING RV ON A LOT.   THE TOWN WOULD HAVE MORE CONTROL OF WHERE AND HOW TRAVEL TRAILERS ARE PLACED.

NEIGHBOR ON EAST RIVER DRIVE IS CONCERNED THAT ALL OF THIS WOULD BE AFTER THE FACT FOR THEIR SITUATION.   THE RV IS 50 FT FROM HER HOUSE. AND SHE DOESN’T UNDERSTAND WHY THE CURRENT ZONING ISN’T BEING DISCUSSED AS THEY FEEL THE RV IS OUT OF COMPLIANCE AS THE CURRENT LAW IS WRITTEN.

ATTORNEY REGAN ADVISED THAT HIS POSITION IS THAT WE ARE EXAMINING TOWN WIDE AND WILL MAKE A DECISION ACROSS THE BOARD GOING FORWARD. HE WILL CONTACT ATTORNEY BITTER TOMORROW.

OTHER COMMENT:  THE SPEED LIMIT ON ROSE AVE AND RIVER ROAD CAME BACK FROM NYS DOT WITH APPROVAL FOR SETTING NEW SIGNS.
