Public Hearing:

Please take notice that pursuant to the Zoning Ordinance of the Town of Lake Luzerne, the Zoning Board of Appeals will conduct a public hearing on July 22, 2021 at 7:00 p.m. at their regularly scheduled meeting.  The meeting will be held at the Municipal Complex, 539 Lake Avenue, Town of Lake Luzerne, to hear comments on the following:

Area Variance 2020AV-7 Applicant:  AT&T Mobility Corp.

Property Owner:  Donna Baker

Parcel No. 286.-1-20.1, Residential Countryside Zone (RC), 16.87 Acres

Location: 60 Hall Hill Rd.., Lake Luzerne

The applicant has applied for a variance from the Zoning Board of Appeals for relief from Article VI (C)(1) of the Zoning Ordinance of Lake Luzerne, requiring a separation distance of the tower from all residential dwellings and building sites of 500 feet or 1 ½ times the height of the tower (202.5 feet), whichever is greater.  The monopine facility will have a total height of 135 feet.  The nearest residential dwelling is 296 feet away.  

A copy of the application as well as other supporting documentation are on file with the office of the Zoning Officer and may be reviewed by interested members of the public during normal business hours (Monday through Thursday, 8:30 a.m. to 1:30 p.m.).

The Zoning Board

The Zoning Board of Appeals (ZBA) consists of five members appointed by the Town Board. Current ZBA members are:

  • James Niles, Chairman
  • James Moeller
  • Annie McMahon
  • Rayl Zubal
  • Matthew Palitsch
  • Burgess Ovitt, Alternate

The purpose of the ZBA is to:

  • Render determinations where variances from the zoning code are requested.
  • Hear appeals from applicants seeking interpretation or reversal of determination by the Zoning Enforcement Officer.
