How does the highway department determine what gets done first?

A problem that is an immediate hazard to the public's health, safety or welfare will be given immediate priority. Otherwise a regular schedule for highway maintenance includes:

  • Sweeping roads in the spring
     
  • Review of roads scheduled to be paved
     
  • Any new projects and/or repairs
     
  • General maintenance
     
  • Spring leaf, brush and white goods pick up. Leaves must be bagged, brush must be bundled, white goods include hot water, stove, washer/dryer. Sorry, no refrigerators or air conditioners due to freon gas (this notice appears each year when scheduled).
     
  • Late Summer: Ditches and culberts are cleaned and roadside brush is cut.

RULES AND REGULATIONS 

LAKE LUZERNE WATER DISTRICT 

TOWN OF LAKE LUZERNE, NY 

AS AMENDED AND ADOPTED  

MAY 10, 2005 

 

  1. NO PERSON OTHER THAN THE SUPERINTENDENT  OF THE LAKE LUZERNE WATER DISTRICT OR EMPLOYEES OF THE DISTRICT UNDER HIS SUPERVISION SHALL MAKE ANY CONNECTIONS, REPAIRS, ADDITIONS OR ALTERATIONS TO THE REPAIRS, ADDITIONS OR ALTERATIONS TO THE DISTRICT WATER MAIN OR TO THAT PORTION OF ANY PIPE THROUGH WHICH DISTRICT WATER FLOWS BETWEEN SUCH MAIN TO AND INCLUDING THE CURB SHUT-OFF.

 

  1. APPLICATIONS FOR WATER SERVICE MUST BE MADE TO THE WATER SUPERINTENDENT ON THE FORM PROVIDED THEREFORE.  PAYMENT  ACCORDING TO THE SCHEDULE OF CHARGES MUST BE MADE IN ADVANCE TO THE COLLECTOR OF WATER RENTS WHO SHALL ISSUE A RECEIPT THEREFORE.  ANY EXCESS OR UNANTIICIPATED COSTS RESULTING FROM THE BREAKING UP AND REPLACING  OF PAVEMENT, REMOVING ROCK, ETC. MUST ALSO BE BORNE BY THE APPLICANT.

 

  1. REGARDING INSTALLATION OF WATER METERS, NEW RESIDENCES MORE THAN 100 FEET FROM THE TOWN SHUT OFF WILL BE REQUIRED TO HAVE A  METER PIT INSTALLED.

 

  1. IT SHALL BE THE DUTY AND OBLIGATION OF THE PROPERTY OWNER TO KEEP THE CURB SHUT OFF FREE FROM OBSTRUCTIONS AT ALL TIMES IN ORDER THAT WATER DISTRICT EMPLOYEES MAY HAVE READY ACCESS THERETO.

 

  1. THE SUPERINTENDENT AND HIS EMPLOYEES, WATER PURIFIER, AND ANY OTHER PERSONS DESIGNATED BY THE LAKE LUZERNE WATER BOARD SHALL BE PERMITTED TO ENTER THE PREMISES OF ANY WATER CONCUMER AT ANY REASONABLE TIME TO EXAMINE THE FIXTURES AND PIPES, ASCERTAIN THE QUANTITY OF WATER USED, TO TEST WATER, TO INSPECT WATER METERS,  AND TO DETERMINE WHETHER THERE IS ANY WASTEFUL USE OF WATER.

 

  1. NO WATER CONSUMER OR PROPERTY OWNER SHALL PERMIT ANY PERSON OTHER THAN THOSE RESIDING OR EMPLOYED ON THE PREMISES, TO REGULARLY TAKE WATER THEREFROM, UNLESS THE COLLECTOR OF WATER RENTS IS FIRST NOTIFIED AND PAYMENT MADE FOR THE ADDITIONAL USE.

 

  1. WATER RENTS SHALL BE DUE AND PAYABLE ON THE FIRST DAY OF JULY OF EACH YEAR, IN ADVANCE, AT THE OFFICE OF THE COLLECTOR OF WATER RENTS.  WATER RENT IS PAYABLE  APRIL 1 (SW2). A PENALTY OF 5% WILL BE ADDED AFTER 30 DAYS. ARREARS NOT PAID BY OCTOBER 15 WILL BE ADDED TO TAXES PLUS A 10% PENALTY FEE. NOTIFY COLLECTOR OF ANY CHANGE OF OWNERSHIP OR ADDRESS.

 

  1.  THE DISTRICT RESERVES THE RIGHT  TO INSTALL METERS ON SERVICE LINES AT ANY TIME AND CHARGE METER RATES FOR THE CONSUMPTION OF WATER BY SUCH SERVICE.  WHEN A METER IS INSTALLED DURING A WATER RENT PERIOD THE SERVICE FEE WILL BE WILL DUE IN FULL THROUGHOUT THE REMAINDER OF THE PERIOD. 

 

  1. THE OWNERS OF PROPERTY SUPPLIED WITH WATER THROUGH METERS  SHALL PAY FOR ALL NECESSARY REPAIRS TO THE METER WHEN  DAMAGED BY ANY CAUSES OTHER THAN THOSE OF NORMAL WEAR CAUSED BY WATER RUNNING THROUGH SAME.

 

  1. IN THE EVENT THAT ANY METER SHALL FAIL TO PROPERLY  REGISTER THE AMOUNT OF WATER RUNNING THROUGH SAME, THE COLLECTOR OF WATER RENTS SHALL ARRIVE AT A FAIR  ESTIMATE  OF USE BASED ON PREVIOUS EXPERIENCE.  THIS ESTIMATE MAY BE SUBMITTED TO THE WATER BOARD FOR APPROVAL.

 

  1. THE WATER BOARD SHALL HAVE THE FULL RIGHT AT ALL TIMES, AND WHEN EVER IN THEIR OPINION THE PUBLIC GOOD REQUIRES IT,  TO REGULATE, DIMINISH OR ENTIRELY CUT OFF THE SUPPLY OF WATER FROM ANY AND ALL PROPERTIES OR PERSONS BEING SERVED AND TO MAKE SUCH RULES AND REGULATIONS FOR THE USE OR DIMINISHING THEREOF AS THEY SHALL DEEM NECESSARY AND EXPEDIENT TO THE CONDITIONS PREVAILING.

 

  1. NO PERSON OTHER THAN THE SUPERINTENDENT, WATER PURIFIER,  OR PERSONS ACTING UNDER HIS DIRECTION SHALL  MOLEST OR INTERFERE WITH OR OPEN OR CLOSE OR ATTEMPT SO TO DO, ANY VALVE, GATE OR SHUT OFF APPURTENANT TO THE MAINS THROUGH WHICH  DISTRICT WATER FLOWS OR APPURTENANT TO ANY SERVICE LINE BETWEEN THE WATER MAIN AND THE CURB SHUT OFF INCLUSIVE.

 

  1. NO PERSON OTHER THAN THE SUPERINTENDENT OR THOSE ACTING UNDER HIS DIRECTION OR A MEMBER OF ANY FIRE DEPARTMENT ON ACTIVE DUTY SHALL MANIPULATE , CONTROL OR OPERATE, OR ATTEMPT SO TO DO, ANY FIRE HYDRANT WHICH DERIVES ITS FLOW OF WATER FROM ANY OF THE MAINS OF THE LAKE LUZERNE WATER DISTRICT.

 

  1. THE OWNERS OF PREMISES RECEIVING DISTRICT WATER SHALL BE REQUIRED TO MAINTAIN IN PERFECT ORDER  AND REPAIR, AT THE OWNER’S EXPENSE, THE SERVICE PIPE AND ITS FIXTURES AND APPURTENANCES, FROM THE CURB SHUT OFF TO AND INTO THE PREMISES, AND IN THE CASE OF METER PITS, IT WILL BE THE SECOND CURB STOP (BETWEEN THE METER PIT AND THE RESIDENCE). SERVICE  PIPE MUST BE METAL PIPE, UNDERGROUND COPPER OR GALVANIZED STEEL.  NO CONNECTION WILL  BE MADE  TO PLASTIC PIPING.   ALL SUCH REPAIRS ARE TO BE MADE UNDER THE SUPERVISION AND DIRECTION OF THE SUPERINTENDENT.

 

  1. THE OWNERS OF PREMISES RECEIVING DISTRICT WATER  SHALL BE REQUIRED TO INSTALL AND MAINTAIN A SHUT OFF AT OR NEAR THE ENTRANCE OF THE SERVICE LINE INTO THE OWNER’S BUILDINGS IN ORDER THAT  REPAIRS TO THE CONSUMERS’ PLUMBING MAY BE MADE WITHOUT CLOSING THE CURB SHUT OFF.

 

  1. NOTICE IN WRITING DELIVERED TO THE COLLECTOR OF WATER RENTS AT LEAST TEN DAYS BEFORE THE ANNUAL BILLING DATE SHALL BE REQUIRED IN ALL CASES OF APPLICATIONS FOR DISCONTINUANCE OF WATER SERVICE; OTHERWISE THE CONSUMER SHALL BE LIABLE FOR THE MINIMUM CHARGE.

 

  1. THE DISTRICT SHALL NOT BE LIABLE FOR ANY DAMAGE RESULTING FROM THE SUDDEN SHUTTING OFF OF WATER TO ANY PREMISES.

 

  1. APPLICATIONS FOR SERVICE WILL BE ENTERTAINED ONLY IF SUCH SERVICE CAN BE SUPPLIED WITHOUT UNDUE EXPENSE.  THE TOWN WATER BOARD RESERVES THE RIGHT TO REFUSE SUCH APPLICATIONS INVOLVING UNDUE EXPENSE UNLESS THE APPLICANT AGREES TO PAY FOR SUCH EXCESS COSTS AND DEPOSITS WITH THE COLLECTOR OF WATER RENTS, IN ADVANCE, A SUM  ESTIMATED TO BE SUFFICIENT TO COVER SAME.  EXTENSIONS TO EXISTING MAINS MUST BE MADE AT THE EXPENSE OF THE APPLICANT, SUBJECT TO  THE SPECIFICATIONS OF THE TOWN WATER BOARD AND UNDER THE DIRECTION AND SUPERVISION OF THE SUPERINTENDENT.  SUBJECT TO AGREEMENT BETWEEN THE APPLICANT AND THE SUPERINTENDENT  SUCH EXTENSION MAY BE MADE BY THE DISTRICT PROVIDED THAT A SUM ESTIMATED TO BE SUFFICIENT TO COVER THE COST OF MATERIALS AND LABOR IS DEPOSITED IN ADVANCE WITH THE COLLECTOR OF WATER RENTS,  SUCH EXTENSIONS AND ADDITIONS TO THE MAIN WHEN CONNECTED WITH THE DISTRICT MAINS SHALL BECOME THE PROPERTY OF THE DISTRICT AND NO CONNECTION WILL BE MADE BY  THE SUPERINTENDENT UNLESS THE APPLICANT FIRST AGREES IN WRITING TO SUCH DISTRICT OWNERSHIP.

 

  1. NO APPLICATION FOR WATER SERVICE WILL BE INTERTAINED BY THE DISTRICT UNTIL ALL WATER RENTS AND CHARGES IN ARREARS, DUE THE DISTRICT FROM THE APPLICANT, ARE PAID IN FULL. IN SOME CASES THIS COULD INVOLVED UNCOLLECTED RENTS RELEVIED AT THE COUNTY INTO REAL PROPERTY TAXES.

 

  1. THE PROPERTY OWNER RECEIVING WATER SERVICE IS REQUIRED TO PROMPTLY REPAIR ANY LEAKS IN HIS PIPES OR FITTINGS.

 

  1. IN THE CASE OF FROZEN WATER PIPES, THE DISTRICT  SHALL BE LIABLE FOR EXPENSE INVOLVED IN THAWING MAINS AND SERVICE LINES TO THE CURB SHUT OFF AND SUCH WORK SHALL BE DONE UNDER THE SUPERVISION OF AND AT THE DIRECTION OF THE SUPERINTENDENT.  THE CUSTOMER SHALL BE RESPONSIBLE FOR EXPENSE INVOLVED IN THAWING SERVICE LINES FROM THE CURB SHUT OFF TO AND INTO THE PREMISES.  IN CASE THERE IS SOME QUESTION AS TO THE RESPONSIBILITY FOR SUCH EXPENSE AT THE TIME OF COMMENCEMENT OF SUCH WORK, EXPENSE WILL BE ASSESSED TO THE PROPER PARTY WHEN RESPONSIBILITY SHALL BE DETERMINED BY THE SUPERINTENDENT.  IN CASE OF DISAGREEMENT OVER THE RESPONSIBILITY FOR SUCH EXPENSE THE DECISION OF THE TOWN WATER BOARD SHALL BE FINAL.

 

  1. A FIFTY DOLLAR ($50.00) FEE WILL BE CHARGED TO TURN OFF AND TURN ON WATER BY TOWN EMPLOLYEES ON REQUESTS AFTER HOURS OR ON WEEKENDS, AND FURTHER THAT THE OWNER OR HIS AGENT SHALL BE PRESENT AT THAT TIME.

 

  1. WATER SERVICE MAY BE DISCONTINUED BY THE DISTRICT AT ANY TIME FOR ANY OF THE FOLLOWING:

 

  1. VIOLATION OF ANY OF THESE RULES AND REGULATIONS
  2. NON-PAYMENT OF WATER RENTS.
  3. USE OF WATER FOR ANY PURPOSE OTHER THAN  AS REPRESENTED IN THE APPLICATION.
  4. WILLFUL WASTE OF WATER THROUGH IMPROPER OR IMPERFECT PIPES.
  5. REFUSAL OF REASONABLE ACCESS TO THE PREMISES BY AUTHORIZED PERSONS FOR THE PURPOSE OF INSPECTING PIPES AND FIXTURES.
  6. VIOLATON OF ANY REASONABLE RULES OR REGULATIONS LAID DOWN BY THE TOWN WATER BOARD OR THE SUPERINTENDENT FOR THE PUBLIC GOOD.
  7. TAMPERING WITH WATER METERS
  8. VIOLATING WATER USE BAN NOTICE.

 

  1. WATER SERVICE SO DISCONTINUED BY ORDER OF THE DISTRICT MAY NOT BE RESTORED UNTIL VIOLATIONS HAVE BEEN CORRECTED AND ARREARS PAID, AN APPLICATION FOR SERVICE IS COMPLETED, AND A SERVICE CHARGE OF $100.00 IS PAID.

 

      25.  SERVICE FEES, METERED WATER RATES, AND DISTRICT TAX RATES  WILL BE SET ANNUALLY BY THE TOWN OF LAKE LUZERNE WATER BOARD AND THE TOWN OF LAKE LUZERNE TOWN BOARD.  SERVICE FEE FOR THOSE SUPPLIED OUTSIDE  THE DISTRICT WILL BE DOUBLE.

 

 

26.  NEW METER INSTALLATIONS MUST BE COMPLETE AND INSPECTED, INCLUDING REMOTE READER BOX, AND WITH ALL REQUIRED FEES PAID TO THE DISTRICT IN ADVANCE IN ORDER FOR THE WATER SUPERINTENDENT TO TURN ON  WATE
